I-9 Compliance: Signs Are Pointing to a Future Federal Mandate of E-Verify
As we reported in our previous blog post, DHS Planning Nationwide Mandate of E-Verify, signs are pointing to a future federal mandate for E-Verify. The latest indicator comes from the recent approval of the Fiscal Year 2018 Homeland Security Bill by the House Appropriations Committee. The bill includes proposed funding “to increase the capacity of the E-Verify system in preparation for a potential transition to mandatory use at the national level in the future.” The budget includes $108,856,000 “for operations and support of the E-Verify program” and $22,657,000 “for necessary expenses of U.S. Citizenship and Immigration Services for procurement, construction, and improvements of the E-Verify program to remain available until September 30, 2021.”
The evidence is stacking up – with funding now moving through Congressional approval – it appears that the current administration is preparing to extend and expand the E-Verify program.
This approval and the details of the proposed Department of Homeland Security (DHS) budget combined with the expected increase in Immigration and Customs Enforcement (ICE) audits highlight the increased scrutiny on I-9 compliance.
While there are many states that require E-Verify for some employers, only 14% of states require E-Verify for most or all employers.* Depending on how you leverage the E-Verify system today, your organization could face a significant increase to your E-Verify processing with a national mandate.
