IRS Letter 226J – The Letter No Employer Wants to Receive.

IRS Letter 226J marked the beginning of the Internal Revenue Service (IRS) enforcement of the Affordable Care Act’s (ACA) employer mandate. It’s the letter no employer wants to receive and many employers are shocked when they do.

Unless an employer responds to the IRS by the response date noted on the letter with an explanation of why they disagree with the assessment along with documentation, the proposed penalty is presumed to be correct. The IRS will issue a notice and demand for payment – climbing into the millions of dollars for many employers.
