New Form I-9 Published on USCIS Website
On Monday, November 14, 2016, U.S. Citizenship and Immigration Services, (USCIS), published the new Form I-9—thus making it official. Employers now have until January 22, 2017 to implement this new form in their hiring processes, or face possible penalties.
The new form, designed to simplify the employment eligibility process and help employers cut back on technical errors, is now 4 pages, with another 15 pages of instructions. This new smart form includes a number of new features, including drop-down menus, hover text and real-time error messages, which are all designed to guide the user through the process and reduce errors—every single data point now has a question mark that provides an explanation of the field when clicked. However, it’s important to note that this form is not an electronic Form I-9 within the meaning of the USCIS regulations, but instead is merely a tool to assist in the completion process.
Given the new form, and the heightened fines, which were in effect as of August 1, employers should closely re-examine their I-9 processes. A truly electronic I-9 system has been using the “upgrades” provided by the new smart form for years, in addition to a number of other tools designed to help make this ever-changing and complex process simpler for employees and employers alike. It’s important to note that even if an employer opts to use the new smart form, they still have to print it out and have the employee and employer sign, and then worry about storage. This is not the case with electronic forms.
