Recent Louisiana EZ Legislation – Retail Industry Limitations
The Louisiana Enterprise Zone Program is a state tax incentive program which offers job and investment credits to new or expanding industries. In June, 2013, Louisiana Governor Bobby Jindal signed into law House Bill 571 which disqualifies many retailers from participating in the program (see link to legislation below). The legislation specifically excludes retail businesses with NAICS codes starting with 44-45 with more than 100 employees nationwide from participating in the program.
While the legislative changes were a disappointment for many large retailers, several other retail-type businesses continue to be eligible:
• Grocery stores and pharmacies are allowed to participate, but are limited to new or expanding stores located in an Enterprise Zone.
• All restaurants and other eating and drinking establishments qualify without geographic limitations.
