The Equal Employment Opportunity Commission (EEOC) Informal Opinion to Form 8850
Over the years many businesses have expressed concern
with the questions asked on the federal Work Opportunity Tax Credit (WOTC) Form 8850
as to whether or not the questions are consistent with anti-discriminatory statutes. The
federal Equal Employment Opportunity Commission (EEOC) responded to the addressed concerns
of businesses (in
a letter dated July 28, 2010).
Their informal opinion in the letter states
that screening employees with the questions on Form 8850 for WOTC is not discriminatory
within the federal guidelines and does not violate equal
employment opportunity laws or the Americans with Disabilities Act (ADA).
